My employer is not issuing experience certificate

Respected Sir,

I, Denny Johny, had been working with X Systems pvt. ltd. Cochin (KERALA), in the Operational department as Business Associate -Operations for 1.3 years commencing on 1st Feb 2012 till my resignation on 9th may 2013 after completing an initial training of 3 months starting from 1st Nov 2011 to 1st Feb 2012. I was relieved from my duties and responsibilities by my Mr.  X (HR Administrator) on 9th may 2013, post my resignation.

 

During my relieving process Mr. X told me that the experience certificate and salary certificate will be provided me after one week. On 17th May 2013, I received my salary certificate but my experience certificate was not given to me on that day.

 

I had few conversation with Mr. X and he told me that the CEO of the company , Mr. Y is not satisfied with me. So he is not ready to issue an experience certificate to me. He told me a lot of silly reasons and I gave proper explanations to prove his reasons as false.

 

I sent few mails requesting my experience certificate. HR replied me that my relieving letter dated May 9th, 2013 does mention about my experience, position and training. But the relieving letter provided me does not contain the particulars of employment (like roles and responsibilities, nature of work etc) and My colleagues who had resigned from the company over the same time period as mine, have received both experience certificate and relieving letter. I quoted these points and replied to HR. But I did not get any response from them till now.

 

I need to join with my new Company on June 3rd and I need to submit my experience certificate with in 30 days. 

 

When I discussed it with one lawyer, he told me that my company don’t have PF account so it will not came under service case. It will be civil case and it will take more than 30 days to solve this issue. This company is a very small company there are only 9 employs and they have ESI.

 

Could you please help me to solve this issue.
