Mutual agreement

Hello there,

I had filed Divorse case against my wife which I have won after 5 years. She (stays outside India) had filed 125 - Maintenance Case which is yet to go for Judgment. Now the Opposite party has come down on Mutual Agreement to close this 125 Case and also that they would Not file in Higher courts.

01) I need to know what points should be drafted in the Mutual Agreement Letter , so that I do not face any issue in future...Please let me know which points to be taken care?

02) Whether i need my own  Lawyer for this matter? I believe my wife's lawyer can do the drafting and all which i can get it verified

I believe that you need to get your own lawyer so that the mutual agreement letter is drafted in your favour rather than the opposite.

main points are to be considered are of maintainece,custody and legal rights after divorce.you can mail me the agreement, i can review at nominal fees.

Thanks for your responses....So waht I  understand, its better to get it done from my own Lawyer....

 

However if the draft is done by the opposite lawyer and i get it checked on my own with a lawyer, would not that suffice?

 

Yes if the case gets complicated, i need a lawyer for sure...
