Mother

Hello,, Regarded Lawyers !!   I want to know.. my  share in property  of my mother's name after her death?

1. The property(X) was name of my mother .

2. we were 4 members in family ,my father,my mother ,my brother& me ( i got married in 1999)

3. My mother died 6.5 years ( in 2007) back.

4.. After death of my mother , my brother transfer this property on his name without informing me( i just came to know about this few days back), my brother  was aware that my signature or consent needed to transfer property on his name , so his wife sign on behalf of me and pretend as his sister during registery ( in some time between 2007- 2010) and my father also inovlved in this act. 

5. On this propoerty my brother borrowed loan.

6. In year 2011 my brother got dead in an accident ,my brother have one son.

7. My Sister~in~law ( Widowed Bhabhi)  got re~married with someone in 2013( it may be rumor or truth as now she reside with some other man) .

7.  Now My  Ex-sister~in~law ( widowed bhabhi) planing to transfer the property(X) on her name/ my nephew or may be she has already done.

 

now i want my share  in Prpoerty(X) , will i  get my share legaly?

After the death of Your mother, dying intestate, the properties should devolve upon the CLASS I LEGAL HEIRS, so in your case you should have got a share, but unfortunately it went the other way, according to you, your brother colluded with your father and had played a foul play. Yes u can claim you share, first find all the property details and go for a PARTITION SUIT.
