Mortgage deed

sir, a person given his landed properties to his second wife and her son and executed a settlement deed in the proper sub-registrars office in the year 1971. the first wife's son obtain a possessory un-registered mortgage deed in his favour for some amount in the year 1975 by his father and the 2nd wife of his father. the first wife's son filed suit for permanant injunction in the court.in the year 2002. he stated that he given further amount to his father as sale considaration in the year 1982. he manage the revenue authorities and gat tax receipts and pattadar pass books for the land. pls advice the defendant. the court didnot grant any injunction.case is in trail.

sir that the person divided his whole properties into 3 shares and one share alloted for his first wife and one share to his first wife's son and the third share was kept by him. the partition deed was registered in the year 1969.
