Maternity Policy in private sector

Hi, My name is Mohit, my wife is working in a private financial advisory company from more than 2 years but the company doesn't providing her paid meternity leaves. They are giving leaves but without pay, company have more than 300 employees and it is pvt ltd. Is maternity act differ from company to company and it is according to employers if no where to file a complaint please suggest.

Such establishment might be covered by Shops & Estbs Act of the state and hence covered by the Maternity Benefit Act until or unless covered by ESI, exempted.

Maternity Benefit (Amendmnet) Act, 2017 

First of all: Submit, under proper acknowledgment, intimation of pregnancy alongwith doctor’s Rx showing tentative date of pregnancy delivery and Maternity Benefit application, and request to supply requisite forms if any, to be submitted by employee, by Redg. Post.

Since your wife was working for more than 2 years and there are 300+ employees, your wife is entitled to maternity benefit act. You have to apply for the benefit under prescribed form with proper acknowledgment. The company may deny anything verbally, but it will be not possible to deny maternity benefit in writing. 

 

Maternity Benefit act does not differ from company to company. First send the form under registered post and if they still deny then you may lodge a complaint before the labour office.
