Maternity leava in private section

Hi, I am working in pharmaceutical sector. new amendement to Maternity Act by govt. of india for the leave extension from 90 days to 180 days is not applicable in private sector? my company claims that they have not received any formal annocement or letter from government to revise the policy. Please help.

Once the emandment to Maternity Benefit Act, 1961, is notified in the Gazette, it shall become applicable from the effective date mentioned in notification.

Check with Inspector (state/central as applicable in your case) appointed under the Act, O/o Labor Commissioner, Employee's/trade Unions.

The establishment has to collect/obtain the notification on its own.

Hello Sir,

Thanks for your feedback. Accordingly i have checked with the state / central inspector. As per their internal emails, the matter is considered as public grievance. Action still ongoing to redressal the grievance. Can you please explain me what is this process as i m not aware about this.

It is felt that the change is not notified, hence is not implemented.
