Is it (Amendment Act of 2005 ) a state subject? Does it apply to all over India?

Parveen Kr. Aggarwal (Advocate)     07 February 2010

The Amedment Act of 2005 was enacted by the Parliament in exercise of the powers conferred under Entry No. 5 of Concurrent List in Seventh Schedule of the Constitiution of India. Entry 5 reads as under:

"Marriage and divorce; infants and minors; adoption; wills, intestacy

and succession; joint family and partition; all matters in respect of which

parties in judicial proceedings were immediately before the commencement

of this Constitution subject to their personal law."

So the Amendment Act of 2005 cannot be called a State Subject and of course is applicable to the whole of India except the state of Jammu and Kashmir as it amends the principal act and shall have the same territorial extent.
