Maintenance claim

hello,

 

my divorce case in trial stage.

 

and maintenance case also coming now I have to file a counter. My age is 50. and my company is going to close soon. I may get compensation but the housing loan and other loans can eat 80 % of my compensation amount.

 

I heard that If I lost my job and I don't have any earrings I can claim maintenance from her.

She is a working women

my both kids are now working and earning that also she have.

 

please guide me is it possible to claim maintenance

 

on which section it comes

 

in counter it self I can claim it

 

please help me... now I am in streets

You can claim maintenance from your children and also your wife, provided the latter is a working woman, has a income which is known to you, have salary slips of such, or can prove to the court of her having immovable property and the same holds good for the former too.  All such evidence need to be provided to the court, after looking into such, only will the court decide on how much maintenance need to be ordered.  In all of this a detailed descripttion be given about such happenings as explained by you above to the court under section 125 crpc.


So start collecting proof about your children's income/your wife's income respectively.
