Maintenance

Dear sir,

Here applicant is a lady having a small baby boy of 6 months. She was resided with her husband hardly for 7 to 8 months. From her 4 th month of pregnancy she is staying with her parents. Now she has filed DV u/s 18, 19, 20 and Maintenance case in family court.

She doesn't have any proof of her husband's salary. he is a driver in aurangabad.

Can u pl suggest any point for her arguments on maintenance. and what are the chances of the order.

1. Inference to Court 'minimum wages’ a driver earns r/w his age and expands oral argument directing towards applicant wife r/w minor child needs accordingly.  

2. If she is well qualified and earning member then she may not get interim maintenance and minor’s maintenance will be shared by her and from her driver husband’s inference earnings. However if she is not qualified – non earner member then she will get maintenance along with maintenance for the minor child of parties.
