Legal notice

we served legal notice to an employee because during the course of employment he started his own business of the same nature simultaneously . but the notice was returned stating no person by that name lives over there. the address is correct.

now what are the remedies available to us ? also how should we get the notice served?

ACCORDING TO THE OFFICE RECORD, THE ADDRESS IS CORRECT.

---   FIRSTLY CHECK WHETHER THE PERSON LAVING AT THAT ADDRESS OR NOT.

CPC HAD THE PROVISIONS, HOW TO SERVE NOTICES.

THE LAST OPTION IS TO SURVE THE NOTICE THROUGH PAPER ADVERTISEMENT.

THEREAFTER EXPERTY.

the address is correct as its permanent residential address.

As admitted by you, the person started his own business and running. You can very well send the notice to his business address otherwise it is only for Paper Publication as adviced by Mr. Arup.

I agree to Ld. Arup suggestion. Even you go for pasting at proposed defendent's physicial address and if email is known then it can also be opted for which are some of the allowed process under CPC.
