One of my friend has bought a LDA house from a third party (to whom house was allotted) on the basis of Registered Power of Attorney and Agreeement to sale (Unregistered) in the year 1999. My friend is also having possession since then on that house. Agreement to sale was not registered as , i think that time it was not compulsory to register it, as amendment has come in the year 2001.
In the year 1999, all the instalments were not paid by actual allottee. Now when, all the installments have been paid my friend in the year 2007, the actual allotte is denying to come to LDA for registry and also filed an application with LDA, that no registry should be done in my friend's name.
Kindly suggest, what remedies are available for my friend.
