I need help determining the jurisdiction for the following case. It will be included in my moot for college.
A husband and wife married in Pune in December 2005. Almost a year after marriage, husband wishes to file for divorce on the grounds of cruelty brought upon by his wife. The wife also wishes to get their unborn child aborted without the husband's consent. He challenges the Medical Termination of Pregnancy Act and files for an injunction against the abortion in the Bombay High Court.
