judicial seperation or divorce case in high court

can a husband file a petition of judicial seperation or divorce in high court if a wife has already won rcr decree and getting maitainance in district court.???husband never wants compromise with her.what he should do?

Dear you can challenge the decree in the High Court ,but if you state in the court you just don't want to live with your wife you need to give solid reasons and only upon that court can decide. The defence against any RCR decree is neither judicail seperation nor the divorce,just challange that decree first,if you suceed you need not to file alternative petitions.
