Judge is refusing to pass orders to send summon third time

I and my grandmother filed a suit regarding our share in property in district court. My grand mother died in the year 2014 december and my lawyer told legal heirs to be added in the suit to proceed the suit since she was dead. On Jan 2015 my lawyer has done the needful things to add the legalheirs in the court . My grand mother has two sons and a daughter. one of the son is not receiving the summon sent to him and my lawyer says the summon was sent to him twice, but he has not received the summon and avoiding the summon and we asked our lawyer to take next step if he not receiving the summon he told that he will take steps to follow and he says now that the judge is not signing the orders to send summon to be present on court and the my lawyer says the judge is continously postponding and refusing to sign the orders to send the summon again. From jan2014 this is going on and there is no end for and my lawyer says the very same thing that judge is not passing orders to send the summon till now and really donk know what to do? two years got over with the same thing and and now its third year for the adding of legalheirs. And keep on asking my lawyer to take the next step if the concerned party is not receiving the summon but he is not ready to take steps and keeps on saying that the judge refuses to pass orders to send summon third time. I really want to know will the judge repeatedly refuse to pass orders to send summon when he accepted to send summon for 2 times why not for third time or will there be any reason? Please guide
