Joint ownership of flat

Sir,

I am going to purchase a flat in Surat, Gujarat. In dastavez of that flat two names are there as owners, one is of son and another is of his mother. They want to sell and I want to purchase that flat.

The problem is that son resides in India and mother resides in London. Can I give him token money and prepare agreement for sale? Her mother will come by 14/11/2016. Is agreement for sale will be valid and can I take legal action as in future the son or mother refused to sell after accepting the token money?

Please advice experts.

Ankit ji u need to take release deed in favour of son from his mother.
