Inam Land

Hi, I'm currently doing the legal due diligence for an apartment in bangalore. My advocate (very knowledgeable) mentions that this is Inam Land and the docs provided by the builder do not show if the Inam land's ownership was transferred in the past. The builders lawyer argues that there is no need to check if this was Inam land as the property was acquired by this seller family via a court partition. Would appreciate your advice on two questions: 1) when doing legal due diligence, is it necessary to check if the land is Inam Land? 2) in case it was inam land and the property was acquired via court partition, then is there still a need to check if the Inam land ownership was transferred? Thank you

'Buyer Beware' is applicable in property deals.

 

Land, Inaam Land is state subject and Karnataka has framed rules on Inaam Land.

These rules need to be pursued, and that whether such land can be sold.

If the title is defective, don't bye. 

Don't fall on verbal arguements.

Your own counsel must have gone thru the applicable rules and also Court Partition.
