Charge Sheet submitted u/s 307 IPC against 5 accused out of which 4 accused faced trial before Session court and acquitted. Complainant made Appeal against acquittal same is pending.
The 5th accused didn't turn up so his warrant was filed for present and case was committed to Session court except him. Now accused no.5 appears and Police not arresting him.
What todo before the ld court below so that accused would be put forward before ld court below. If Police not arrest court will sit idle in regard to absconding accused.
