How to make payment to employee as per order

Dear Members,

 

Please guide how to make payment to employee as per order passed by labour court to make payment to employee.

 

whether we should directly give cheque to employee

 

or deposit cheque in labour court.

pls guide

Dear Sam,

 

The mode and process of the payment is generally mentioned in the Court Order itself.  In the absense, clarification can be sought and the payment can be made to the employee by obtaining the valid documents in this regard,

the labour court order says that "make payment to the employee by deposting the amount in this court."

 

please guide whether cheque is to be prepared in name of employee and deposit in the court or cheque is to be prapared in name of the court.

Of course orders of the Labour Court are clear. You have to deposit the amount in cash in the Labour Court for which you can get receipt of the Court. For deposit of cheque in the name of employee you may have to seek clarification of the Court.

you can make payment directly to the employee and file the receipt in the court and present him to aknowledging the payment. However, it will be better to deposit the same in the Court through Bank Draft.

In my opin, we should directly deposit the cheque , favouring EMPLOYEE NAME in the court by way of making a separate application mentioning the cheque details and annexing the Original Cheque with.  T he court can in turn handover the same to the opponent by recording the same in Court's ROZNAMA. However, Mr. Tripathy's opin is also correct as that is one of the way through which the money can be paid to Opponent  However, considering the details as mentioned above, i would advise you to deposit in the court, and get it recorded in COURT's ROZNAMA.
