High court order- license suspension

hi

i was looking at the recent high court verdict in chennai,where in it says, the driver in accident doesnt need to surrender his license until proven guilty... does it mean, if a driver knocks someone down, he cannot be arrested/neither his license gets suspended until he is proven guilty,which usually take years to conclude. this is not a academic question..but trying to understand the recent order.. looking forward to hear your view on this..
