@ the author, 

u need to act ... sitting / just thinking wont help.

evenif the husband is not having any income, no court will consider his application u/s 24 of HMA positively ... and there is no other provision in law whereby husband can claim maintenance from earning wife.

 

file the cases & serve the summons/notices on his parents address. evenif the husband is absconding, his property can not abscond.

further, the co-accused parents of the husbands will make him appear from his hideout.

 

for filing cases, & court work, u need a local lawyer. dont expect to learn everything at online forums, ofcourse they are helpful.

 

& about husbands remarriage ... forget it ... till now he must have made SOME ARRANGEMENT ... thats why he is not in a hurry to get divorce from you. ... simply understand that - ur marriage is already broken & u just need official court order to that effect.

I understand your problem, in your message, "your husband is not staying with you" and you unable to find-out Following Idea's

1. Polic complaint for  missing husband

2. if found you can case file against him for non caring and not providing basic facility which is the respocibity of husband.

3. If fail above you can take divorce form him 

4. If nothing it happend don't warry life is beutiful. you can start your life again with self emplyeed. JEENE KE LIYE KISI KE SAHARE KI JARRORAT NAHI HOTI " APNE DAM PAR JIYO"

DP-7(3) gives immunity to the complainant/ aggrevied person. Thus DP-3 cannot be filed against the wife.

as per Section 3 of the Dowry Prohibition Act, giving or abetting to give dowry is a punishable offence, but the petitioner (woman) does have protection of Section 7(3) of the Act. Section 7(3) provides that notwithstanding anything contained in any law for the time being in force, a statement made by the person aggrieved by the offence under the Act shall not subject her to prosecution under this Act.”
