A Case of Crl Intimidation(Sec 506) is pending at trial court. BWs issued against the accused as the complainant is a cousel himself.
Apprehending free & fair justice, accused filed Transfer Petition in Supreme Court as matter is Inter State.
Queries:
1. During the pendency of the matter can the accused apply for any pray at superior courts. eg- Personal exemption at Session Court, or High Court.
2. Assuming the SC dismisses the application and refers the case back to trial court. However accused does not want to appear in the proceedings at trail court as the complaint is resourceful and manipulative & will file further false complaints against the accused in case he appears in person. Is there any provision where accused can be represented by his counsel?
