Gratuity & Earned leave encashment for outsourced employees

I have worked in Manappuram Finance ltd for 6.25 years on annual contract basis with contract being extended every year.I was terminated after 6.25 years. When I have applied for gratuity and earned leave encashment, they have rejected the same stating that outs�urced/contract employees are not elgible for the same.Kindly clarify whether I am entitled to the same, if so, how to proceed against the management.

If there was no break in service and you have evidence of employer-employee relationship then you might succeed.

Do you have it?

Have you asked in writing and have they declined in writing?

Does the contract provide for Gratuity Scheme?

Does it offer superior benefits than offered by Payment of Gratuity Act?
