This is regarding challenging the gift deed done by my mother. Which she wants to challenge in the court against the gift she has given it to my brother who is no more in this world.
We are total 3 siblings One sister and 2 brother. I am the last sibling in the family.
The site belongs to my mother(uneducated) when my brother wants to build the house, he took her sub register office and told my mother that if you give your thumb impression the bank will provide the loan to build a house. Due this my mother gave her thumb impression and with other 2 witness the gift deed got registered.
The problem started when my brother expired in 2010, we family members paid the loan amount in the bank and got it released from the bank than only we came to know, what my brother has done.
The witness of the sales deed, friend of my brother as well as mine, I asked them even they did not read the gift deed papers. They ready to come to court and say this fact what has happened.
The real problem started after this my mother was thrown out of the house by sister in law one night. after exactly one month after my brother death.
Please let me know can my mother challenge the cancellation of the gift deed on the basis of cheating and not care of the my mother who is almost 75 yrs old.
Please advise can my mother challenge the gift deed.
