Full and final settlement

In my offer letter have mentioned after 3 month my salary will be variable and performancd. I have resigned on 4th month and hr accept and confirm that my full and final settlement under process and eill get shortly. 1 month is over till have not get the settlement amount.please advice how will get my final settlement.

Serve the said company with a legal demand notice . Most companies pay once they have been served with a legal noticd
