Pls help me in the following matters :
1. One sales officer is working with us but since 1st september'08 his services has been terminated and processing his full and final settlement. At the same time, his TA/DA expenses are pending for 5 months.
2. He has approached us and sent a notice to us under Section 80 CPC through his lawyer from Allahabad High Court for full & final settlement.
3. The employee has not worked for 3 months as per his Area Manager informed and he has advised many times to improve the performance but he could not do that. Without any other option, he has informed us that his services can be terminated and issued termination letter effective 1st september.
4. As per notice, he is claiming wrongly his TA/DA whereas we have already paid for those months.
All members are requested to please advise me about the above case.
