Fraud by mobile insurance company

Sir plz help in a mobile insurance company fraud i had a apple i phone for which i took mobile insurance thinking that it will help me in case of need. Unfortunately my phone was damaged due to unavoidable circumdtancez. I deposited my phone with the company representative as it was itself a Herculean task. The company rejected my claims giving false reasons and only after 6 when i threatened to go to court they agreed that it is there mistake and assured me that my phone will be repaired. Nothing happened till now. There company nos is mostly swith off , the company representative has fled, i have all the call records, e mail correspondence and documentary proof, z help me how can i get my phone back from company.
