Sir/Madam,

We have registered several police complaint against the party who is continiously harasing us. Instead of taking any action against them, the police prepared a kalandra against both the parties.

Below are objections against the investigation report prepared by I.O.

  1. The opposite party never ever registered any written complaints against us.
  2. The investigation report is prepared by I.O, who has never ever visited our place for record of statements/investigation
  3. The statements recorded by I.O in Kalandra were from opposite party only. No statement was recorded from our side in this regard.

Despite an aggrieved party, we have been facing trial in SEM court for last six month and continuously receiving life threat from other party. we have been unnecessary implicated / framed in the above case on the basis of false statements made by the other party, which has no substance and has been made just to save their skin.

Please help, Can I approach Session/High Court against SEM and police authority.

IN CASE YOUR COMPLAINT IS NOT RECORDED BY THE POLICE YOU MAY FILE A PRIVATE COMPLAINT TO THE CHIEF JUDICIAL MAGISTRATES COURT MENTIONING ALL FACTS.YOU WILL SUCCEED.

THE FALSE CASE FILED AGAINST YOU ,YOU MAY DEFEND THE SAME STRONGLY .FIRST APPLY FOR BAIL .THEN YOU MAY FILE WRIT PETITION TO THE HIGHCOURT FOR QUASHING FALSE CASE AGAINST YOU MENTIONING ALL FACTS AND YOU WILL SUCCEED.GOOD LUCK.

Sir, thanks for your valuable support. Sir, since the case is still under trial in SEM court, can I approach Session/High Court for redressal or I have to wait for SEM decission.
