Maternity leave

Hi,

मै  ये जानना चाहती हूँ की अगर कोई कंपनी किसी कर्मचारी को प्रसूति - छुट्टी देने से इंकार करे तो इसके लिए क्या कोई कर्मचारी कंपनी पर  केस कर सकता है.

The pregnant woman should be employee of the company.

Has the company declined to grant Maternity Leave in writing?

{Obtain declinature in writing even if by email}

Has the woman employee (who is pregnant) has the informed the employer about pregnancy in writing along with copy of Doctor’s Rx mentioning tentative date of delivery and has the employee submitted any format/form supplied by the company for the Maternity Leave?

{ Submit Notice AS AP preferably by redg. post}

The company should be one which has not been exempted from the Act and employee should be eligible for the leave, as per provisions of Maternity Benefit Act.

The employee may go thru Maternity Benefit Act 1961;

Section: 1,2, 3(e) (o), 5 , 6, 13, 15, 17, 20, 21, 23………………………

Maternity Benefit Act 1961;

Govt. have made amendment in section 5(2) by Act 61 of 1988  and 160 days has been substituted as 80 days.


Therefore while you go thru the Act attached above, consider 
80 days....................................
