We are members of a group housing society in Gurgaon. The members are staying in this society since 2006. The promoter President (Also the financer/builder of the project) of the society has not approached Haryana Urban Development Authority for getting the completion certificate. We need to know if we can file a case against the promoter president to have the completion/occupation certificate done for us.
The old working committee of the society headed by the promoter president was disolved by the Registrar of societies office in Jan 2013 as the tenure had expired in April 2012. A new working committee has been formed. Is the new working committee now accountable for the past non compliance of the promoter president?
Are the members of the society now collectively responsible to get the completion certificate obtained from the competent authority in absence of the promoter president? Can we file a case against the promoter president and inform the competant authorities that completion will be applied for after resolution of the court case?
