Contractor workers

I seek ur valuable advice on the following:

My org. is engaging drivers on contract basis through contractor for driving Corporation's cars. Their working hours is from 7:30am to 4:30 pm with a lunch break from 11:30 to 1:30 pm.

Now, suppose a driver is on official travel with some official from 11:am to 2:30 pm and takes the day off on normal timings, i.e. at 4:30pm. Can he claim OT for the lunch period during which he was engaged on duty.

In another case, if the driver is on duty (local travel) with an official for 11am to 12pm and again at 3pm he is on travel wit another officer till 6:30 pm, then what will be his OT caluted for the day?

The drivers are daily rate workers and their wages are paid based on their regular attendence and OT at the end of every month..
