Can Non-owner elected as secretary

Can a Non-registered owner (son of flat registered owner) elected as a secretary in apartment association..His name doesn't appear in sale deed.....If so, does Karnataka Owners Apartments act 1960 permits... In GBM, inspite raising this point members going ahead in appointing him by arranging NOC from his father who is registered flat owner.. Flat located in Bangalore, association registered under Karanatka owners apartment act 1960.. Association byelaw don't have this provisioning currently.... What are the options available as a flat owner, if this appointment is illegal......
