Passport renewal

Dear Sirs I am seeking your kind advice as my passport has expired and I want to renew that but I have to declare on the below in the passport application : "Have you ever been charged with criminal proceedings or is any arrest warrant/summon pending before a court in India" But a case under Domestic Violence act is pending against me. Now what should I do? Regards
