Formal distribution of property

Respected Sir/Madam

I wish to put the following points for kind consideration and valued suggestion by the forum members:-

  • My father and his elder brother have been appelants for a registered family settlement in the form of a will by my grand father.
  • Probate order has been passed and Letter of Administration has been issued. Now, my father's elder brother is not ready for formal distribution of land between him and my father. It is pertinent to mention that my father's elder brother is making use of a greater part of the property, however informally. My father's elder brother is a Civil lawer and doesnot want to give my father equal rights in the property contrary to the will of my grandfather. For my father's claim he utters different rules that being a farmer my father doesnot know about.
  • It is also pertinent to mention that property under question was bought by my grand father in the name of his three sons. All of three were minors at the time of purchase in sixtees.
  • My granfather made his will with the signatures of all his three sons and distributed his entire property among them in 1988 before his death. My grandfather also got the document registered for which probate has been granted in 2015.
  • My father is a farmer with almost no means. The eldest of his btorhters was a govt school teacher and is no more. The 2nd no. brother is a law practioner in civil court. In probate petition, my father and his lawer brother were co-appelants while the eldest filed caveat.
  • Once, myself and my elder brother got employed, my father's lawer brother lost interest in the probate case, but my father who had some resources by now post employment of his sons, furthered the case and got the probate. Myself and my elder brother are employed in govt sect. and my father's lawer brother tends to threaten us indirectly to get us implicated in criminal cases. We have limitations for using court and law due to our nature of job.

Waht should my father do to get his part of property. We wish to advance peacefully.

Regards,
