SANJAY GOYAL (Technical Trainer)     19 February 2014

Forced resignation by giving ex gratia amount

Trauma and Tragedy of handling employee in Tetra Pak India Pvt. Ltd., Pune

Subject: Termination from job in Tetra Pak India. Pvt. Ltd., Pune, India

I wish to get your kind attention that I have been employed in Tetra Pak, India as capacity of Technical Instructor.

Responsible persons like Mr. Olivier Cocheril, Director, Capability development, TS& S Global and service Hub, India), Mr. Guatam Bajaj, Manager and HR Director of Tetra Pak India Pvt. Ltd., Pune, India forced me for submit resignation on dated 27 June 2013. One day decision took place, which forced me to sign resignation letter which was prepared by them & provoked me to take ex gratia amount.

Unofficially, They made false allegation against me like non performance and not fit for the job by ignoring company Midyear review 2013. They continuously asked me to sign on resignation on personal reason. Even they console me to leave company with good hand shake and assured me of an impressive experience letter. Otherwise, I would not get good recommendation, once you next employer enquire you.

After 2 days, I complaint and communicated my incident to Sweden H.O and M.D., Tetra Pak India for reconsideration of my forced resignation, in which I mentioned malfunctioning of department and line manager and so on,

After that, Indian Management asked me to write apology that I was upset and have no regret from anybody and further, they told me not to communicate anybody from company people or peers in future. If not so, they were ready to fire me by giving 3 months basic pay. fianlly i took ex gratia amt. and submitted resignation.

Without any prior notice and written intimation given to me, surprisingly, responsible people created such kind of circumstances. This is mental agony and psychological harassment.

I was confirmed employee of this company after completing temporary period of 6 month. If they would have told me earlier, then I should not settle with my family.

After getting confirmation, I was settled with family. I paid huge sum to school for getting my son admitted here in Pune [India] and incurred massive expenditure in transportation, renting house and huge relocation expenditure. It is well known fact that settling in Pune is an expensive affair.

I had been relocated my family from my home town [Northern India] in March this year where my wife quit her good job in Engineering college as Assistant Prof.

I am the only bread winner of my family and I have a responsibility to support not only my own family but also to my older parents at Gwalior, where my mother suffers from IVth stage Cancer.

Tetra Pak is an internationally reckoned brand in the World having certain values and ethics toward its own family and I am one of them.

I make humble request to suggest me in whole case, as I am suffering from high mental disturbance.

 Thanks Sanjay Goyal

You had resigned then withdrew your resignation and then again submitted your resignation.

YOU could demand the payment of relocation expenses etc………………………

By the limited understanding from your post it seems that you have erred.

Online discussions have its own limitations.

Pune is a good city and you can find good labor consultants/service lawyers.

Meet your lawyer in person.

He may suggest some remedy.

You may proceed only after you have understood the merits.
