Flat possesion delayed in aurangabad

Dear Sir/Madam,

I have purchased flat in Aurangabad with a reputed builder in Jan'2014. I have gave 95% amount at the time of registry to the builder on the condition that I will get possession in Sep'14 only. at the time of flat booking we saw they constructed alomost 85% of the building.

This is Sep'15 still the building construction is same only. We are everyday calling to get the appointment of the buidler but  we are not getting the appointment as well as the tentative date of possession. Its a year & nine months now we paying EMI for flat.

Kidly advise what to do????? as we have only this home at this point in time. we have all our earning on this dream home, and now we dont have any amount in hand.

Pls pls advise.........

You can discuss other person who has taken flat in the same venture.

send him a notice demanding the reason as to why there is a delay as the deadline for giving posession is over by sep 14.you can move to the consumer forum for deficiency of services

Hi,

I have the same problem with my flat in Bangalore. I have booked the flat in 2011 and the posession date is Dec 2014. But till now, i dont see ant change in the building. Only the walls were constructed. The builder is changing the posession date often and not even communicating to anyone. I had discusison with project manager and the CRM of the builder and according to them, the reason for dealy is builder doesnot have funds and not getting any loan ( I have recorded all these details while having the meetings). My questions are:

Can I go against the builder in consumer court with the recording proof and the photos that I hae which shows no signs of development?

How much time will it take for this issue to get resolved? (many other tenants are scared that it may take years for this to get resolved and so they are not ready to take legal action)

Please help.
