Experience letter

I was working with State Street Syntel Pune for 4.9 months and absconded due to personal problem in  March 2014,

I had recieved termination letter from the HR, I am aware that I am not eligible for relieving letter but can I get experience letter from them. please advise thanks.

Why to abscond, absent, abstain….?

Why to invite allegation of misconduct?

Why to fetch order of termination?

Relieving letter signifies that; employee has separted and nothing is due against employee.

You can ask for both.

In relieving letter employer may mention reason for separation. 

If employee has sent notice/final resignation by ordinary post the copy may be supplied to employer for acknowledgment/acceptance and to get FnF statement, FnF settlement, Form16, salary slip of all months, service ecertificate,relieving letter, PD a/c slips, ESIC card, NOC/NDC  etc etc .

If employee has sent notice/final resignation then employee has not absconded.

an employer cannot be compelled to give experience letter.  They may refuse or just write the experience they had with you.

There are various registers/forms that  employer is liable to maintain and submit under Shops & Estbs Rules.........................including on DOJ/LED and separation.

Employee can act to obtain such under RTI.

 

e.g; Form N in Tamilnadu Shops & Estbs Rules.
