Examination in chief

can a cross-examining advocate ask the witness to repeat byheart (without seeing into it) what is stated in his affidavit of examination in chief?

The court is a Temple of Justice with serious business of litigations, and not an extempore speech competition club. The cross examiner can ask any leading questions but not such rehersal of memory, if at all he wants to contradict the witness he has to show the witness his previous statements reduced in writing.

Thorough preparation also will ensure that the witness appreciates the lawyer’s competence.

Statement or evidence already submitted and recorded in the court cannot be made to repeat or rehearse by the defence counsel.
