e-mail evidence

Hello,

 

Further to my query on the maintenance issue in a separate post, would like to know how far e-mails can be used as an evidence against wife, especially  when the husband has shared password of  his wife in the past to screen her mails. Husband never replied to her mails, conveying to wife that she should keep writing and he would reply her on phone. 

Your opinions on this would be appreciated.

Seems these are one sided email messages. Contents may be relevant as secondary evidence if it were for venting out frustration of marrital life on fault of herself (used by husband side to show her fault in mariage) and flip side if it is if they were ventings of husband fault then it may not be of much use to show by husband as they were never replied back and could be challenged under burden of proof by wife's side.


Recently emails exchanged between both NRI husband and wife were used by the husband side as evidence of fault of wife before Hon'ble SC and they were widely quoted in its Judgment by the Apex Court too but seems your briefs does not have such elements as rpelies were by phone (pop voice recordings from wife side with context of / reference to emails then case may take different turn may be).
