DVC was running on Me and my mother,during the case i had to go out of country for employment. and could not attend the court ,my mother used to attend but due her poor Health condition she also could not attend few appearance at court.my advocate did not file the counter stating i was not available.
court has ordered exparte order with compensation and maintenance.
it is almost 1yr from order passed .i m not paying any amount to my wife.i have no kids and she is highly qualified and working.
1.can i set aside this exparte order in same court or higher court.?
2.do i have to pay all the amount since the order has issued to allow set-aside petition.?
3.on what Conditions set-aside could be allowed ?
