Divorce in case of suicide threats fr wife illegal relation

Hi,

I am NRI , married 4 years ago( 2010). My wife got visa after little struggle and joined me in US in 2012. After coming to USA, I came to know that she was in love with someone else in india and continuously in touch with him. I have her emails and phone records calling to him. After a 1.5 months, her boy friend attempted suicide and sent email to her. Week later she kept sucide note ( didn't mention about her lover but mentioned that i was not eating food mader by her.) and left home for suicide ( this is second attempt) . I lodged a complaint with local police in US. Finally the same day evening i found her and brought her home after talking to police officers. After that I could not bear her anymore and brought her back to India and handed over to her parents. I explained to parents and her elders.  It has been 2 years since then we havn't been intouch. Her parents are demanding to live together or pay lot of money.   Now I want to file for divorce and legally get separated from her. Even though i don't want marry anyone now and honestly I hate women after seeing a girl can do this after marriage. Anyway I don't want any strings attached to my life so I want to get divorced.  In this case, Can I file for divorce? If so, Do I need to stay in india until the case is over? also I am worried about 498a case they may file wrongfully. Even though it will be turned down eventually but have to go through that phase and time. So what is the best approach in this case. Please advise.

Thanks,

Santosh

@ Author,

1. Ever heard; YOU  KNOW  YOUR  WIFE  WELL  ONLY  WHEN  YOU  MEET  HER  IN  COURT OR MEET HER HALF WAY!

2. If above is hard to grasp then in plain simple way it is advised to you to part company by mutual consent divorce route meeting their alleged to be un-reasonable demands 'halfway'
Reasoning: You are knowledgeable queriest as the way you talk of various laws and trump about self appointed social approach, thus, it is suggested to opt a practical approach as being NRI person your youthful productive years should not be sacrificed in Indian Courts for a cheating woman in your life who happens to be your legally wedded wife is my practical viewpoint to your query.

3.
Otherwise meet in-person (or over skype) with any seasoned Indian advocate all laws - counter cases - wriggle out ways amongst others you will come to understand, offcourse by meeting consultation fees.

4. Flip all above paras, just invest your own time in reading last 500 discussions in family law / criminal laws forums here in Lawyersclubindia and make your own notes and you have found answer(s) to your own question(s) and then follow your notes to a ‘just’ conclusion.
