Divorce

will the amendments to the law with regards to the divorce laws ease of the procedure for divorce for men. since the courts accept the divorce application after one year of marriage will it be a valid ground If the couples have not been living together for 1 year.....

1) Govt. is actually trying to bring Muslims under the purview of HMA - like provisions thru back door by creating a separate bill which is called as Hindu Marriage Law Amendment Bill, 2010.

2) The Bill, 2010 talks of equality but nothing of that sort mentioned in Hindu Marriage Law Amendment Bill, 2010 - which means woman (wife) can "apply" to court to get a new husband, while husband has to be at the mercy of wive's "permission".

3) Hindu Marriage Law Amendment, 2010 intends to increase the property to wife - as wife can do multiple marriages with courts' help just by "alleging" cruelty on no. 1, no. 2 and so on so forth husband !

4) Hindu Marriage Law Amendment Bill, 2010 takes away the husband's right to file for divorce under 13 (1)-(ia) cruelty grounds by wife!!!! --- THIS IS THE MOST SIGNIFICANT change via this new Bill, 2010.

5) Hindu Marriage Law Amendment Bill, 2010 promotes polygamy for woman.

6) Hindu Marriage Law Amendment Bill, 2010 turns Courts into "permit" distribution center for wives to get multiple husbands.

No illustration has been given as to why / when a wife can "apply" for second husband.

7) Hindu Marriage Law Amendment Bill, 2010 itself talks that no woman would like her husband to have a second wife, while at the same time says that permission for second wife lies with first wife!!

SURPRISE - on how did media interpreted this bill as that for "irretrievable breakdown" of marriage...this bill is infact going to be another bomb - shell like DV on husband's finances in the day's to come.

Fantastic work by Legislative body I must say.
