Divorce

Hello sir,

im 24yr old married 2years back. i have a lot of issues in my marriage both emotionally and physically.my husband is into it by proffesion not a regular guy who values a relation.he is like a monarch wanted to run everything on his norms. on the top of it he has severe phimosis.im still not consummated. i always tried to help him and get his problem corrected but he is not ready for that....and he is like he is not happy with marriage.on the top of he earns alot and his whole families only source of income is from him een to his married sister her(her and children husband) after me going there his family was scared their finciacial souce of income from him may ruin as he started getting closer to me. so they were behind him al the time neer left him alone or gave me a chance to have some place in his mind.he also had very bad habit of listening to his uneducated mother who wanted me to stay home cook food do all other things leaving al my clinic work behind. i seriously defended it.finally my husband left me in my maternity home for awhile and not returning back to pick me.he is left abroad im trying hell to reach him he and his family not answering us.my husband wanted to leave me alot of elders tried to put up our relation but he never listens.so i decided to leave it as im trying hard since two years to put it up.so please kindly help me the way to approach to apply for divorce and deal with this thing.im not ready for mcd as i gain nothing from it.i still have pg to complete9 for which i need to attend coaching for which i need money.

You can file a divorce case on the grounds of non-consummation of marriage, non cohabitation for more than two years (if marriage was consummated, but you said it is not), cruelty and desertion, along with you can also file a petition seeking interim maintenance in the same case or under section 125 cr.p.c. Consult a local lawyer and move as per his further advise.
