Division of property share

Dear sir, We have undivided property since last 3-4 generation but now we wanted to divide it equally among all shareholders, by mutual understanding but unfortunatelly it did not happanned and now situation is to take help of court. One year before second party has compalined about us on a thana and based on complain police refer the case to sdo cour by putting section 147 and 107. Section 107is over now and 147 is still going on. Now we wanted to have some constuction work on property which is in our posession but second party is complaining that u cant on disputed land while 147 is going on, Is this true??? And lastly what is the procedure to get divided smoothly with the help of court.
