Disputed Full and Final

Respected Sir, I joined an International School as General Manager Admin on 21 August 2014. The Trustee on 21 October 2014 disabled my company mail ID, and phone internet. I got a call from HR to resign. Since my salary was held up I resigned. There was no negativity on my part but still they asked me to resign. I resigned on 28 October 2014 and got my salary check in first week of December. No handing over, no relieving letter received by me till date. They credited my basic pay as notice pay and forfeited the rest amount. Also they have not given me salary slip till date. My provident fund status is also not known to me. Kindly help to get peace of mind as they have devoured my money. The appointment letter states that one month salary is admissible. I have sent 16 reminders to them till date.

The school is affiliated to which board? You may go thru the Service Rules advocated by the Board and also under State Education Act and can approach the authorities.

You had tendered notice of resignation or resignation?

Did you serve the notice period? Is it mentioned in appointment letter that during notice period only Basic pay shall be paid?

Were you made member of PF upon joining and deduction was made from salary for employee’s contribution? Have you asked to supply the PF number and PF a/c slip of each year?

Is the school covered as ‘Commercial establishment’ by State Shops and Establishments Act? If yes you might be covered as ‘Employee’ in the Act and can approach Inspector appointed under this Act.

Why was your salary held up?

Did you mention in notice/resignation that you have been forced to resign OR do you have any evidence that you were forced/coerced to resign?

Have you been supplied FnF statement and have you accepted it by signing it?

The alternatives are approach the authorities of affiliated Board, State Education Act, employee’s unions/forums, issue legal notice thru your able labor law Consultant/service matters lawyer/law firm, and approach court of law.
