My mom and brother reside in a Co-operative Housing Society in mahim the flat is in the joint name of father and mother and my father has passed away in 2011 without leaving a will or declaring any nominee in the house agreement documents . My brother has been chasing me since last 2 year to sign the NOC stating below . I say that I have no objection to transfer my share in the flat in favour of my mother along with the society shares nos 36 to 40 evidenced by share certificate no 8 of said flat.
My brother initially told me the below procedures but talks only about the NOC. My mother refuses to give me a share in the house please advice and tell the right procedure . My father family is in support of my brother and mother
Forms/ Papers that we need to give to society mentioned in order as per requirement.
1. Form 17 - needed when applying for membership if there is no nominee.
2. Our (yours and mine) NOC affidavit - saying we have no objection in transferring the flat to mummys name
3. Form 19 - Indemnity bond to society
4. Form 4 - Use of flat
5. Form 14 - Nomination form - in which our name will be written with discussed ratio. 70:30 (agreeable to me)
