Is there any case laws supporting female employee to work after 7 p.m? pls post ur reply with the citation.

it shall be sufficient for you he concerned Shops and establishment act since if you look into the act it specifies the timing for women to work in the day time only (except for factories) like for Delhi it is upto 9 pm.

As per the recent amedments to the Factories Act, women are permitted to work in factories even after 6.00 p.m . I think this rule is not applicable for other industrial units and establishments.

I think it depond on the environment of different countries. but actually womens are not safe to work at night and even not have a good relation with family also.

Flg is the answer for the querry about working hours for women:

There are no rulings or court orders.

Depending on the place of work  is mandatory that women are not to be engaged in the night.

Sec 66 of Factories act:- women should not be engaged between 07 pm to 6 am. xemption for certain establishments can be given but is again restriction is that they should not be engaged between 1000 pm to 0600 AM.

Shops and establishemnt Act which is a state legislation also specifies that women should not be engaged beyond 0800 pm (varies from state to state).

In case the employer is not following this rule you can just call Factories Inspector (or) Labour Inspector for factory and shop respectively and inform. They will come and inspect and prosecute the employer. There is not need to inform the informant's name also. Just give the name of the establishement and they will act.

I forgot to mention.

For IT/BPO/ItES comapnies states have given exemption so that women can work in the nights. This is under Shops & Establishments Act,which again State specific.But the comapny has to apply and take specific exemption from the Govenrment.

It is believed that you are located at a  office of the bank e.g. branch/main branch/RO etc.

Usually the office are prescribed in appointment letter or by office order confirming change in office hours. The breaks are also described e.g lunch break, tea break. Bank office hours are usually say 10 am to 06 pm.

Including 1 hour breaks the office hours are 9 hours.

It is felt that the negotiations with the bank are based on Shops and Commercial Establishments Act

Kindly look into the Shops and Commercial Establishments Act in force in your State.

SBI staff association, has mentioned :

13.5                OVERTIME

b)         Normally, the total period of work including overtime shall not on any day, exceed, in the case of workmen other than members of the subordinate staff, 8 1/2 hours and in the case of members of the subordinate staff, 9 hours, excluding the period of recess. In case, however, of an emergency, of which a responsible officer of the Bank shall be the sole judge, or when the exigencies of Government work at the close of the financial year so require, a workman can be required to work in excess of the aforesaid hours. The provisions herein shall be subject to the provisions of any law relating to the ceiling on the hours of work or overtime applicable to the Bank. Branch Managers should ensure that employees are not permitted under any circumstances to work overtime in excess of the number of working hours prescribed in the Shops and Commercial Establishments Act in force in their States.
