Google tracking data in incognito mode

Hi, Learned Counsel,

Google Tracking data in incognito mode, is it a violation of Right to Privacy.

Also, Aware me regarding what happened in the lawsuit against google in the same concern

Greetings

The lawsuit alleges that Google's incognito mode is in violation of privacy laws as it does not inform the users that their data is been collected. US district judge, Lucy Koh stated, "“The court concludes that Google did not notify users that Google engages in the alleged data collection while the user is in private browsing mode." 

As a result google faced a $5 Billion lawsuit over tracking users for in incognito mode.
