Defamatory Comments by the accused’s brother
When the Police went to serve the Bailable Warrants to the accused , his brother made derogatory remarks to the Police person against the complainant, like the complainant is a cheat, thug etc etc
1.Can a suit for defamation be filed against the persons who so said
2.Is there any bar on the said Police Personnel deposing in the case in the Court during the proceedings?

If the comments are publicly that too any loss incurred on his reputation because of comments, then only defamation case can be filed.

Well is it not a defamation that he said objectionable things to the Police Personnel?
And I also asked Is there any bar on the said Police Personnel deposing in the case in the Court during the proceedings?

Dear Ashok,
This is the tendency of every opposite party to utter defamatory language against each other nothing new. This will be of futile exercise, sheer waste of money and time. No body will support you case. ask that police official he will immediately refuse. Take a chill pill let the dogs bark.
