Deemed conveyance

Deemed Conveyance .

Dear Sir,

 

Our society is situated at Thane (Mumbai-Maharashtra) and duly registered in JAN-2010.

We made follow up with builder for making conveyance deed but till date there is no response from him.Now our society decided to go for deemed conveyance .

In Our society there are two flats which are till date empty and legal case is going on in the court against builder and with two old residents (Before Redevelopment) .

 

My Question is

What is the way of getting deemed conveyance after considering above facts ?

 

Pls guide and respond ASAP.

There is nothing like deemed conveyance. Send a notice demanding registration of your flats. If the builder does not respond, file a specific performance case with a prayer seeking the court to register the property in the event the builder fails to register.

Dear Amit,

Thanks for the info.

 

Maharashtra Ownership Flats (Regulation of the Promotion of Constriction, Sale, Management and Transfer) Act, 1963.

 

This act is applicable in maharastra so advocates from other states will not be aware.

However, thank you for providing the information. I have only seen the title of the Act and have not yet read the provisions.
