criminal law query

hii everyone pls ans this

A was sentenced to rigorous imprisonment for 2 months for a criminal offence. after the expiry of the period of the sentence, he filed an appeal against his conviction and sentence and prayed for the condonation of delay on ground of imprisonment. will the court be justified in extending the period of limitation in this case

give explanation for ur answer also this is a 4 marks question.

In view of S.376(a) & 376 (b) of Cr.p.c. the accused in the present case has no right of appeal and therefore question of filing an appeal does not arise and therefore issue of condonening delay also would not arise.  However the accused will have a right of revision.  The Limitation for filing a revision is 3 months and therefore condonation may not be needed if he files revision petition immediately after coming out of the prison.

is one can file a complain u/s 138 of the N.I.Act, if  cheque is returned with endorsment

 " BANK IS UNDER SECTION 35 -A OF THE RBI"

IF YES.......... THEN ON WHAT GROUND.
